Important Notice: Precautionary Suspension


On 19 February 2019 the Constitutional Court gave judgement on the matter between Allan Long v South African Breweries (Pty) Ltd and Others.

The Constitutional Court upheld the Labour Court Judgement that an employer is not required to give an employee an opportunity to make representations before a precautionary suspension with full salary.

This means that employers may suspend employees with full pay without the employee having first be given the opportunity to present their side with regards to the suspension.
